Ken Beauty LLC, doing business as KenBeauty (“Ken Beauty,” “KenBeauty,” “we,” “us,” or “our”), respects your privacy. This Privacy Policy explains how we collect, use, disclose, retain, and protect personal information when you visit www.thekenbeauty.com, purchase products, subscribe to communications, participate in a consultation or matching service, join a community, enter a giveaway, communicate with us, or otherwise use our websites, forms, content, products, or services (collectively, the “Services”).

This Privacy Policy is part of our Terms of Service. Additional notices may apply to particular activities. In particular, health-related information is also governed by our separate Consumer Health Data Privacy Policy and any consent presented before collection.

1. Scope

This Privacy Policy applies to personal information that Ken Beauty controls through the Services. It does not replace the privacy policies of independent third parties, including Shopify, payment providers, shipping carriers, Mailchimp, Zoom, Read AI, social-media platforms, affiliate vendors, and any intake or scheduling provider. Those organizations may process information under their own terms and privacy notices.

2. Eligibility and children

The Services are intended only for adults who are at least 18 years old. We do not knowingly offer the Services to or collect personal information from anyone under 18. If we learn that a person under 18 submitted personal information, we may delete it and terminate access. A parent or guardian who believes a minor provided information may contact us at thekenbeauty@gmail.com.

3. Personal information we collect

3.1 Information you provide directly

Identity and contact information, such as full name, billing and shipping address, email address, telephone number, date of birth or age confirmation, country, state, and social-media username.

Account and transaction information, such as Shopify account credentials, products purchased, order history, transaction status, discount codes, gift information, and communications regarding an order. Payment-card information is generally processed by Shopify and the selected payment provider rather than stored directly by Ken Beauty.

Newsletter and marketing information, including email address, subscription choices, campaign engagement, and unsubscribe preferences.

Consultation and matching information, including photographs, skin or hair concerns, medical conditions, allergies, medications, pregnancy or breastfeeding status, past cosmetic procedures, current skincare products, current DIY activities, prior medspa treatments, reactions or complications, desired results, experience and comfort level, and other health, wellness, beauty, or peptide-related information you choose to provide.

Audio, video, transcript, note, and scheduling information from recorded Zoom consultations, including information processed and stored through Read AI or another disclosed recording/transcription provider.

Content and communications, including customer-service messages, emails, direct messages, reviews, comments, community posts, giveaway entries, testimonials, and any files or content you submit.

Membership and community information, including Discord username, membership status, access history, community participation, and moderation records.

3.2 Information collected automatically

Device and network data, such as internet protocol address, browser type, device type, operating system, language, approximate location derived from IP address, and device identifiers.

Usage information, such as pages viewed, links clicked, referring and exit pages, date and time of visits, interactions with content, cart activity, and conversion events.

Cookie and similar-technology information, including session identifiers, cart and checkout cookies, consent preferences, analytics identifiers, affiliate attribution, and advertising identifiers when those technologies are enabled and permitted.

Security and fraud information, such as login activity, checkout-risk signals, failed payment attempts, and information used to prevent misuse, fraud, or unauthorized access.

3.3 Information from other sources

Shopify and connected Shopify applications, payment providers, fraud-prevention services, and shipping carriers.

Mailchimp or another email-marketing provider.

[Jotform or final intake provider], Zoom, Read AI, and any disclosed scheduling or cloud-storage provider used to deliver a requested consultation.

Social-media platforms when you follow, message, tag, mention, or interact with Ken Beauty through those platforms.

Affiliate vendors and advertising partners that report aggregate clicks, conversions, commissions, or campaign results.

Public sources and information you have chosen to make public, where permitted by law.

4. How we use personal information

Provide, operate, personalize, and improve the Services.

Process and fulfill orders, payments, shipping, returns permitted by policy, replacement claims, and customer support.

Create and manage customer accounts, memberships, communities, consultations, forms, appointments, and recordings.

Provide educational product matching, consultation recaps, digital content, courses, books, downloads, and community access requested by the customer.

Communicate about orders, appointments, policy updates, account matters, security, customer service, and other transactional matters.

Send newsletters and marketing communications when permitted. You may unsubscribe from marketing email at any time, although you may continue to receive transactional communications.

Measure website and campaign performance, analyze aggregate trends, troubleshoot, and improve content. Identifiable consultation content, uploaded health photographs, and health fields are not used for targeted advertising or audience building.

Protect safety, rights, property, and security; prevent fraud, abuse, harassment, unauthorized copying, chargeback misuse, and unlawful activity; enforce our agreements; and establish or defend legal claims.

Comply with tax, accounting, legal, regulatory, recordkeeping, and law-enforcement obligations.

Carry out another purpose disclosed at collection or with your consent.

5. Legal bases for international processing

Where laws such as the European Union General Data Protection Regulation or United Kingdom data-protection law apply, we process personal information under one or more of the following legal bases: performance of a contract or steps requested before entering a contract; compliance with legal obligations; our legitimate interests, such as operating and securing the Services, preventing fraud, supporting customers, and improving our business, where those interests are not overridden by individual rights; and consent, including explicit consent where required for sensitive or health-related information. You may withdraw consent prospectively, but withdrawal does not affect processing already completed lawfully.

6. How we disclose personal information

We may disclose personal information only as reasonably necessary for the purposes described in this Policy, including to the following categories of recipients:

E-commerce and hosting providers, including Shopify and its service providers.

Payment processors and payment options selected at checkout, such as Shopify Payments, Shop Pay, PayPal, Apple Pay, Google Pay, or installment-payment providers when enabled.

Shipping, postal, fulfillment, printing, and delivery providers.

Email and communication providers, including Mailchimp and email-hosting services.

Consultation processors, including [Jotform or final intake provider], Zoom, Read AI, scheduling providers, and secure storage providers, only as needed to provide the requested service.

Professional advisers, including attorneys, accountants, insurers, auditors, and consultants, when reasonably necessary and subject to appropriate duties or restrictions.

Security, fraud-prevention, analytics, cookie-consent, and information-technology providers.

Government authorities, courts, regulators, or other parties where disclosure is required by law, legal process, or reasonably necessary to protect rights, safety, or security.

A successor or transaction counterparty in a merger, financing, reorganization, sale of assets, bankruptcy, or similar business transaction, subject to applicable law.

Other recipients at your direction or with your consent.

We do not disclose identifiable consultation information, photographs, recordings, or testimonials publicly unless you provide separate, specific permission for that use. A general consultation consent does not authorize public marketing use.

7. Sale, sharing, and targeted advertising

Ken Beauty does not sell personal information or consumer health data for money. We do not use identifiable consumer health data for targeted advertising, cross-context behavioral advertising, or advertising-audience creation. Some analytics, advertising, or affiliate technologies used on ordinary storefront pages may be treated as a “sale,” “sharing,” or targeted advertising under certain privacy laws even when no money is exchanged. Where required, we provide a cookie preference tool and a Data Sharing / Targeted Advertising Opt-Out mechanism. We honor applicable opt-out preference signals when technically supported and legally required.

8. Consumer health data

Consultation forms, no-makeup photographs, health and medication information, procedure history, reactions, symptoms, pregnancy or breastfeeding status, and related information may constitute consumer health data. Review our separate Consumer Health Data Privacy Policy before submitting this information. We use consumer health data to provide the service you request, maintain consultation records, communicate with you, protect security, and comply with law. We do not sell it. Collection that is not strictly necessary to provide a requested service requires the specific consent presented at the point of collection.

9. Cookies and similar technologies

We use cookies, pixels, local storage, software development kits, server-side technologies, and similar tools for store operation, security, cart and checkout functions, preferences, analytics, affiliate attribution, embedded media, and advertising when enabled. Nonessential technologies are controlled through the cookie banner where required. See the Cookie Policy for additional details and use the “Cookie Settings” link in the website footer to change your preferences.

10. Email and marketing communications

Newsletter subscriptions are voluntary and should use a separate, unchecked marketing opt-in. Marketing email is sent through Mailchimp or another disclosed provider and includes an unsubscribe method. We may retain limited suppression information so we can honor an unsubscribe request. Transactional emails concerning orders, security, appointments, or requested services are not marketing and may still be sent.

11. Social media and third-party services

Our Services may link to or embed content from third parties, including Instagram, TikTok, Rumble, Facebook, Discord, Amazon, affiliate vendors, and other websites. When you interact with those services, the third party may collect information under its own privacy policy. We do not control third-party privacy practices. Avoid sending medical emergencies, highly sensitive health information, or payment-card data through social-media direct messages.

12. International transfers

Ken Beauty is located in the United States. Personal information may be processed in the United States and other countries where our service providers operate. Those locations may have privacy laws different from the laws where you live. Where legally required, we rely on recognized safeguards, contractual protections, consent, or another lawful transfer mechanism. International customers should review the privacy terms of Shopify and each third-party provider used for the requested service.

13. Retention

We retain personal information only for as long as reasonably necessary for the purposes described in this Policy, including providing Services, maintaining business and transaction records, complying with tax and legal obligations, resolving disputes, enforcing agreements, and protecting security. Retention varies by category:

Order, payment, shipping, tax, and accounting records: for the period required by applicable law and legitimate recordkeeping needs.

Newsletter information: until you unsubscribe or request deletion, subject to a limited suppression record used to honor your preference.

Consultation forms, photographs, signed consents, recaps, recordings, transcripts, and related files: generally up to five years after the consultation or last related activity, unless deleted earlier following a valid request, retained with consent, or required for legal reasons.

Customer-service and legal communications: for as long as reasonably necessary to resolve the matter and maintain an appropriate record.

Cookie and analytics information: according to the settings of the applicable platform or cookie, which should be listed in the live consent-management tool.

A request to delete information may be subject to lawful exceptions. Consumer health data stored in backups will be handled in accordance with applicable Washington law and our Consumer Health Data Privacy Policy.

14. Security

We use reasonable administrative, technical, and physical safeguards appropriate to the nature of the information, such as access controls, passwords, two-factor authentication where available, limited administrative access, encrypted transmission offered by our providers, and service-provider restrictions. No method of storage or transmission is completely secure. You are responsible for maintaining the confidentiality of your account credentials and for notifying us of suspected unauthorized access.

15. Your privacy choices and rights

Depending on where you live and subject to legal exceptions, you may have the right to request access, confirmation, correction, deletion, restriction, portability, or a copy of personal information; object to certain processing; withdraw consent; opt out of sale, sharing, targeted advertising, or certain profiling; and appeal a refusal. You may also unsubscribe from marketing or change cookie preferences.

Submit a privacy request to thekenbeauty@gmail.com with the subject line “Privacy Request.” Describe the request and the account, order, email address, or consultation involved. We may request information reasonably necessary to verify identity and protect the account. Authorized agents may be required to provide proof of authority and verification may still be required directly from the consumer.

We will not unlawfully discriminate against you for exercising a privacy right. If applicable law permits an appeal and we deny a request, reply to the denial with the subject line “Privacy Appeal.”

16. Additional rights for EEA and UK individuals

If applicable, individuals in the European Economic Area or United Kingdom may have rights to access, rectification, erasure, restriction, data portability, objection, and withdrawal of consent, and may lodge a complaint with the data-protection authority where they live or work. Ken Beauty’s processing of health-related or other sensitive information may require explicit consent or another recognized legal condition. Because our consultation intake may involve sensitive health-related information, international availability may be restricted while legal requirements are reviewed.

17. Washington consumer health-data requests

Washington consumers and individuals whose consumer health data is collected in Washington should review and use the request process in our Consumer Health Data Privacy Policy. That policy provides additional rights concerning confirmation, access, withdrawal of consent, deletion, processors, and appeals.

18. Changes to this Privacy Policy

We may update this Privacy Policy when our Services, vendors, laws, or practices change. The “Last updated” date shows the latest revision. Material changes may be posted prominently or communicated through an appropriate channel. Unless law requires otherwise, changes apply prospectively when posted. We will obtain new consent before collecting, using, or disclosing consumer health data for materially new categories or purposes when required.
