Terms of service

These Terms of Service (“Terms”) are a legally binding agreement between you and Ken Beauty LLC, doing business as KenBeauty (“Ken Beauty,” “KenBeauty,” “we,” “us,” or “our”). They govern your access to and use of www.thekenbeauty.com and all related products, books, digital content, consultations, matching services, courses, memberships, communities, promotions, communications, and other services we provide (collectively, the “Services”).

By visiting the website, creating an account, placing an order, submitting a form, purchasing or booking a consultation, joining a membership or community, downloading content, or otherwise using the Services, you agree to these Terms and the policies incorporated by reference. If you do not agree, do not use the Services.

2. Eligibility and adult-only Services

You must be at least 18 years old and legally capable of entering a contract to use the Services. By using the Services, you represent that you satisfy these requirements. We may request age verification and may cancel or restrict access if eligibility cannot be confirmed.

3. Changes to the Services and Terms

We may update the Services, product offerings, prices, features, policies, or these Terms. The effective date identifies the current version. Changes apply prospectively when posted unless law requires otherwise. Your continued use after an update constitutes acceptance to the extent permitted by law. Material changes may be communicated through the website or another appropriate channel.

4. Accounts and information accuracy

Guest checkout and customer accounts may be available. You agree to provide current, complete, and accurate information and to protect login credentials. You are responsible for activity under your account. Notify us promptly of suspected unauthorized use. We may refuse, suspend, or terminate an account or order for fraud, abuse, policy violations, security concerns, or unlawful conduct.

5. Products, descriptions, pricing, and availability

We try to describe products and Services accurately, but colors, images, packaging, dimensions, and appearance may vary by screen, print run, manufacturer, or supplier. We do not warrant that every description, image, price, availability statement, or other content is error-free. Prices and availability may change without notice. We may correct errors, limit quantities, reject orders, or cancel a transaction before fulfillment. If we cancel a paid order, we will issue the refund required for the canceled item.

6. Orders and acceptance

An order confirmation is an acknowledgment that we received the order, not a guarantee of acceptance. We may decline or cancel orders for suspected fraud, pricing or inventory errors, prohibited destinations, policy violations, payment issues, unusually large quantities, or other legitimate reasons. Products may not be purchased for unauthorized commercial reproduction, distribution, or resale unless we agree in writing.

7. Payments, taxes, and third-party payment services

Payments are processed through Shopify and the payment option selected at checkout. Available options may include Shopify Payments, Shop Pay, PayPal, Apple Pay, Google Pay, credit or debit cards, and installment-payment providers when enabled. You authorize the applicable provider to charge the total shown at checkout, including taxes, shipping, and other disclosed charges. Third-party payment terms also apply. You are responsible for taxes, duties, customs charges, currency conversion, and import costs not collected at checkout.

8. Shipping, delivery, and international orders

Processing and delivery estimates are not guarantees. Shipping is subject to carrier operations, weather, customs, address accuracy, supply conditions, and events outside our reasonable control. Risk and title transfer as provided by applicable law and the selected shipping terms. International customers are responsible for destination-country restrictions, import requirements, duties, brokerage, taxes, and delays.

You must provide a complete and accurate delivery address. Contact us immediately if an address is incorrect. We cannot guarantee changes after an order enters processing. Additional costs caused by an incorrect, incomplete, refused, or undeliverable address may be charged to the customer where permitted by law.

9. Physical-book sales: final sale and damage replacement

All physical-book sales, including signed or personalized books, are final. We do not accept returns, exchanges, or refunds for change of mind. If a book arrives materially damaged, email thekenbeauty@gmail.com within three (3) calendar days after the carrier marks the shipment delivered. Include the order number, photographs of the shipping package, shipping label, and damage. If the claim is approved, Ken Beauty will replace the damaged book at no additional product cost. We may require the damaged copy to be returned or made unusable before replacement. This remedy does not limit rights that cannot legally be waived.

Carrier delay, ordinary handling marks, minor color variation, minor manufacturing variation, or damage reported after the three-day period may not qualify for replacement, except where applicable law requires otherwise.

10. Digital products, downloads, courses, and membership content

Digital books, PDFs, downloads, courses, recordings, templates, membership materials, and similar content are licensed, not sold, for your personal, noncommercial use unless a separate written license states otherwise. Because access may be provided immediately, digital purchases are final and nonrefundable once delivery or access begins, except where law requires otherwise or we agree in writing.

You may not copy, scan, record, reproduce, upload, transmit, share login credentials, distribute, resell, publicly display, create derivative commercial products from, or otherwise exploit digital or membership content without written permission.

11. One-on-one consultations and matching services

Consultations are generally one hour and are booked directly through Ken Beauty by email and conducted through Zoom or another disclosed platform. A consultation is not confirmed until payment is completed, required forms and consents are submitted, and Ken Beauty confirms the appointment in writing.

All consultation purchases are final and nonrefundable after the required disclaimer, policies, and consents have been reviewed, acknowledged, and electronically signed. Consultation purchases are nontransferable unless Ken Beauty agrees in writing. Rescheduling, late-arrival, no-show, cancellation, and expiration decisions are subject to the written booking instructions and Ken Beauty’s discretion until a separate scheduling policy is approved. If Ken Beauty cancels and cannot offer a reasonable replacement time, the unused consultation fee will be refunded.

You are responsible for providing complete and accurate information. Ken Beauty may decline, pause, or end a consultation if information is missing, the participant is under 18, consent is withdrawn, the requested subject is outside the educational scope, the participant behaves abusively, the session presents safety or legal concerns, or medical evaluation is needed.

12. Recording consent

Consultations may be recorded, transcribed, and summarized through Zoom and Read AI only after the participant provides the required written recording consent and confirms consent at the beginning of the session. You may not record, screen-record, transcribe, photograph, livestream, or distribute a consultation without Ken Beauty’s prior written permission. If you do not consent to a recording and recording is required for the selected service, Ken Beauty may be unable to provide the service; any refund rights will be determined by the written booking terms and applicable law.

13. Educational and informational purposes only

KEN BEAUTY IS NOT A MEDICAL PROVIDER. THE SERVICES, CONSULTATIONS, BOOKS, VIDEOS, POSTS, PRODUCT MATCHING, COMMUNITY CONTENT, AND OTHER MATERIALS ARE PROVIDED FOR GENERAL EDUCATIONAL, INFORMATIONAL, AND ENTERTAINMENT PURPOSES ONLY. THEY ARE NOT MEDICAL ADVICE, DIAGNOSIS, TREATMENT, PRESCRIBING, OR A SUBSTITUTE FOR CARE FROM A LICENSED PHYSICIAN OR OTHER QUALIFIED HEALTHCARE PROFESSIONAL.

No physician-patient, nurse-patient, clinician-patient, therapist-patient, pharmacist-patient, or other licensed professional relationship is created. Ken Beauty does not evaluate whether a product, procedure, medication, peptide, device, technique, or treatment is safe, lawful, appropriate, or effective for you. You are responsible for obtaining individualized advice from appropriately licensed professionals and for complying with all laws, instructions, contraindications, age restrictions, and product labeling.

14. Medical emergencies and concerning symptoms

Do not use the Services for emergencies or urgent medical attention. If you believe you are experiencing a medical emergency, serious reaction, vascular compromise, infection, breathing difficulty, severe pain, vision change, neurological symptoms, or another urgent condition, call 911 or your local emergency number and seek immediate evaluation from a licensed medical professional. Do not wait for a response from Ken Beauty, email, social media, a consultation, or an online community.

15. Independent decisions and assumption of responsibility

Any decision to purchase, use, inject, ingest, apply, combine, store, reconstitute, recommend, or perform anything discussed in the Services is your independent decision and responsibility. You agree not to rely on the Services as individualized medical clearance. Results vary and no outcome is guaranteed. References to personal experience are not promises that another person will have the same experience.

16. Products, vendors, affiliate links, and third parties

The website may contain affiliate links, discount codes, vendor directories, Amazon storefront links, product reviews, and links to third-party products or services. Ken Beauty may receive a commission or other compensation at no additional cost to you. Compensation does not make Ken Beauty the manufacturer, seller, fulfiller, medical provider, or guarantor for a third-party product.

Third-party purchases are governed by the seller’s pricing, availability, shipping, returns, warranties, safety information, eligibility rules, terms, and privacy policy. We do not control third-party inventory, formulation, quality, legality, labeling, instructions, claims, or customer service. You are responsible for reviewing the seller and product before purchase or use.

17. Memberships, Discord, and communities

Membership and community access may require a separate subscription and community rules. You must treat others respectfully, protect confidential member information, avoid harassment, impersonation, spam, illegal sales, medical claims presented as professional advice, and unauthorized sharing of paid content. We may moderate, remove content, restrict access, or terminate membership for violations, safety concerns, chargeback abuse, or conduct harmful to the community. Fees already paid are nonrefundable to the extent permitted by law when access is terminated for a violation.

18. Giveaways and promotions

Giveaways, contests, promotions, and sweepstakes may have separate official rules, eligibility requirements, entry periods, territorial restrictions, and prize terms. The separate official rules control if they conflict with these Terms. Promotions are void where prohibited.

19. User content, reviews, and submissions

You retain ownership of content you submit, but you represent that you have the rights needed to submit it and that it is accurate, lawful, and does not violate another person’s privacy, intellectual property, confidentiality, publicity, or other rights. You may not post private health information about another person without authorization.

When you voluntarily submit a written review or nonconfidential comment for publication, you grant Ken Beauty a nonexclusive, worldwide, royalty-free license to host, reproduce, format, and display that review in connection with the Services. Identifiable photographs, private messages, consultation content, recordings, before-and-after images, or testimonials will not be used publicly without separate, specific permission. We may remove content but are not obligated to monitor everything.

20. Intellectual property

The Services and their contents, including the KenBeauty and Ken Beauty names, logos, branding, website design, DIY Blueprint books, text, photographs, illustrations, diagrams, graphics, videos, audio, downloads, courses, templates, consultation materials, and compilations, are owned by or licensed to Ken Beauty and protected by applicable intellectual-property laws.

Without prior written permission, you may not copy, scan, reproduce, distribute, republish, upload, scrape, frame, mirror, modify, translate, sell, license, commercially exploit, remove rights notices from, or create derivative works from protected content. You may not record consultations, distribute consultation recaps, share purchased books or downloads, or use Ken Beauty content to train a commercial model, build a competing product, or misrepresent endorsement.

21. Prohibited uses

Use the Services for unlawful, fraudulent, deceptive, harassing, abusive, threatening, defamatory, infringing, or unsafe purposes.

Circumvent security, access controls, payment requirements, geographic limits, or membership restrictions.

Introduce malware, scrape at scale, interfere with the site, test vulnerabilities without permission, or collect other users’ information.

Impersonate another person, provide false information, submit another person’s health information without authority, or create an account for a minor.

Resell, redistribute, publish, or commercially exploit Services or content without authorization.

Use consultation or educational content as medical advice for another person or present yourself as licensed based on Ken Beauty content.

Submit knowingly fraudulent chargebacks or payment disputes.

22. Electronic communications and signatures

You consent to receive electronic records and transactional communications at the contact information you provide. Electronic acceptance, checkbox acknowledgment, typed name, e-signature, and related audit records may be treated as your signature to the extent permitted by law. Marketing consent is separate and may be withdrawn.

23. Privacy

Our Privacy Policy, Consumer Health Data Privacy Policy, and Cookie Policy explain information practices and are incorporated into these Terms. Privacy or health-data consent is not expanded merely by accepting these Terms. Where separate affirmative consent is required, a separate request will be presented.

24. Disclaimer of warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES AND CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, AVAILABILITY, OR RESULTS. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR SUITABLE FOR YOUR PARTICULAR NEEDS. NOTHING IN THESE TERMS EXCLUDES A WARRANTY OR RIGHT THAT CANNOT LEGALLY BE EXCLUDED.

25. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KEN BEAUTY LLC AND ITS OWNER, CONTRACTORS, SERVICE PROVIDERS, AND REPRESENTATIVES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES; LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS; OR DAMAGES ARISING FROM THIRD-PARTY PRODUCTS, VENDORS, PLATFORMS, SHIPPING CARRIERS, USER CONDUCT, OR RELIANCE ON EDUCATIONAL CONTENT. TO THE MAXIMUM EXTENT PERMITTED BY LAW, TOTAL LIABILITY ARISING FROM A PARTICULAR PAID PRODUCT OR SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID KEN BEAUTY FOR THAT PRODUCT OR SERVICE DURING THE SIX MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. THESE LIMITATIONS DO NOT APPLY WHERE PROHIBITED BY LAW, INCLUDING TO LIABILITY THAT CANNOT BE LIMITED.

26. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Ken Beauty LLC and its owner, contractors, and representatives from third-party claims, losses, liabilities, and reasonable costs arising from your unlawful conduct, violation of these Terms, infringement of another person’s rights, unauthorized distribution of content, false information, or misuse of the Services. This section does not require indemnification for Ken Beauty’s own conduct where prohibited by law.

27. Suspension and termination

We may suspend or terminate access, cancel an account, remove content, or refuse future Services when reasonably necessary for security, legal compliance, nonpayment, fraud, chargeback abuse, harassment, intellectual-property violations, community-rule violations, or material breach. Provisions that by their nature should survive termination will survive, including payment obligations, intellectual property, disclaimers, limitations, dispute terms, and confidentiality obligations.

28. Governing law and venue

These Terms are governed by the laws of the State of Washington, without regard to conflict-of-laws principles, except to the extent mandatory consumer law in your jurisdiction applies. Unless an attorney-approved arbitration clause or other dispute procedure is later adopted, exclusive venue for disputes will lie in the state or federal courts serving Snohomish County, Washington, and the parties consent to personal jurisdiction there. Consumers retain any nonwaivable rights under applicable law.

29. Informal dispute resolution - attorney review required

Before filing a claim, the parties should attempt in good faith to resolve the dispute by written notice. Send a description of the dispute, relevant order or account information, and requested resolution to thekenbeauty@gmail.com and the mailing address listed above. Counsel should determine the notice period and whether arbitration, small-claims procedures, class-action terms, or other dispute provisions will replace or supplement this section.

30. Force majeure

Ken Beauty is not responsible for delay or failure caused by events beyond reasonable control, including carrier interruption, severe weather, natural disaster, public-health emergency, labor dispute, internet or platform outage, cyberattack, governmental action, customs delay, war, civil disturbance, or supplier failure. This does not excuse payment obligations already due or rights that cannot legally be limited.

31. Severability, waiver, assignment, and entire agreement

If a provision is unenforceable, it will be modified to the minimum extent necessary or severed, and the remaining provisions will remain effective. Failure to enforce a provision is not a waiver. You may not assign these Terms without written consent. Ken Beauty may assign them in connection with a business transaction or by operation of law. These Terms and incorporated policies are the entire agreement concerning the Services, except for a separately signed agreement or policy that expressly controls a particular service.
